What is the best course of action when the perpetrator probably has no money to begin with?

Part of me says to just ignore it. The guy has absolutely no pull and the best revenge is to
continue shooting and show him that he has absolutely no effect.

I could nail him for copyright infringement. He had two of my photos up on his page. Again..
he probably has no money and it would cost me a fortune to find out.

Defamation of character? Again, no money to be gotten.

(( He did post my own words )). But taken way out of context.

I think the best course is to ignore it

His photography is piss poor at best - I highly doubt that site gets any traffic. You have
enough references to prove otherwise. Fuck him.

I had a local photog who was a printer at a pro lab I used steal one of my shots and put it
in his portfolio. I only found out 'cause a go go dancer I was showing my portfolio to
recognized it from his! But yeah, I let it go.... Now a company would be a different
story....

I would let SLE take care of it, he seems determined to get this guy.

If you guys collectively don't think it's worth it, then just contact his service provider
and threaten THEM. Then they can just shut down his site to get rid of the hassle.

Go with a cease and desist for all of the above along with a take down order for the
offending site. I would be tempted to try for a libel action despite him not having much,
being broke would at least shut him the fuck up and who knows, he might learn a lesson from
it as well.

site... fotunately he fixed it after his host sent him a demand to do so.

Well, you might have something as far as stealing your work but you just bitch-slapped his
ol' lady in public on the WWW. That puts you in the same category as far as defamation.

Without knowing what was said and by whom and the reasons it's a piss in the wind. Contact
legal council in Meatworld.

Don't pay attention to me. I've only been dealing with thse issues as an admin on a
different board since '01.

You have to prove that it's put a financial burden on you through loss of income. If you're
able to prove what was said is not true and able to show a loss of revenue, then you can
probably win. If he has no money, then you have that part of it to deal with.

There's a major difference between some of us pointing out the fact that his wife is a whore
(in the strictest sense, they offer sex for money with her or did at the time the comments
were made) and him implying or directly stating that we rape our models & sell them in to
sex slavery

They've apparently been stalking me here on MM. The quote from me on his page pointing
people to the old Escort thread is less than 2 weeks old.
Everyone found out about that page from me, and *I* found out because his wife messaged me a
little hate letter on MySpace that included the URL of the page.
Apparently he's holding a grudge

The main issue *I* have is that, like with the death threats being easy for Jebbia to brush
off but harder for me, this guy lives 45 minutes from my house & he works in the same market
area I do.
Last thing I need is for a client here in the area to Google me & find that & say "How come
you're on this page?"

One option.....copyright infringement is a crime under federal law. Now you will probably
not get any help.......but go to the FBI and report it. If it is an escort service and they
are targeting them in your area then they might go after the criminal charges. ("Might"
being the operative word........"doubtfully" would also fit the sentence correctly.)

If I hadn't been drinking earlier this evening, I could think about the real issues a little
more clearly. Knowing you personally and having met you does make me a little biased on
your side since the site seems like one major blowhole of frustration.... small minds, and
all that tripe. Have to cogitate on concrete possibilities regarding resolution of arbitrary
allegations because not everyone who wanders into the site can see the forest for the trees.

I have no idea who these people are you speak of but geez... what's the old adage about
airing dirty laundry?

This is a subject near and dear to my heart.............

Are you talking about copyright infringement or defamation of character?

If someone is using your images, and representing or selling them as their own, first you
have to send a cease and desist notice. If you know they have actually sold the image(s),
and can prove it, you can sue them for a sum reasonable to their profit from such.

In the case of defamation of character, that gets a little tougher and harder to prove in
court. You need people that will go to court and testify that so and so said this or that.
Then you have to be able to prove that what was said about you is not the truth.

Myself and several other photographers I know have gone though this periodically. Every six
months to a year I hear something new about me and other well respected photographers in my
area. It's always interesting, every story I've heard to date had no basis in fact and was
able to be traced back to a model that didn't make the cut in a test shoot or a photographer
that was envious of my work. Oh well, what comes around goes around, my favorite was a
photographer that made some serious accusations about me and two other photographers about
two years ago, We sent him a C&D Notice. I saw him about a year ago, he knocked on my studio
door, I did not let him in.... he stopped by to say goodbye, he had just finalized his
divorce and was moving out of the country.

It's kind of odd, because I have a full time studio, have been in business since 1988, I'm a
member of the Better Business Bureau, and I have a listing in the yellow pages. I've never
had one complaint filed with the Better Business Bureau and if the stories I've heard about
me were true not only would the Better Business Bureau drop me, I'd probably be in
jail.................

I just keep moving on, when I can prove something and have witnesses that will stand up in
court, I'll nail someone's @$$ to the wall, in the mean time, I just keep working,
ultimately the nay sayer's are only hurting themselves and models I could potentially work
with that believe them. I have several models that I work with that have told me that they
hesitated working with me because they were told this or that about me. Once they work with
me they realize they were sold a bill of lies and stop working with the source of the story.

Such events have slowed some of my projects, but ultimately come back to hurt not only the
source of the"info" but also the aspiring talent that may have had an opportunity to work
with me.

This is one of the reasons I don't often update my online ports, as much of my work has
either been copied or some wanna be has tried to copy a recent concept or style I've shot.

I simultaneously feel so sorry for women who can't figure their way out of a paper bag how
to deal with life and end up with morons like Alton and can't help feeling a supreme sense
of contempt for them at the same time. I've run across a few during my years in
family/matrimonial law ... it never ended well.
